Record for Accident Resulting With Material Damage

With the increasing population in today's conditions, the number of vehicles on the road has also increased, which makes daily traffic accidents inevitable. What happened as a result of the accidents also puts the survivors and the people who had to wait for hours in the traffic due to the accident even though they were not involved in the accident, in a difficult situation. Situations such as waiting for the traffic police for a long time, not moving the vehicles before the police come, etc. increase the victimization a little more and affect the flow of traffic negatively. In order to eliminate all these problems mentioned above, the provisions regarding traffic accidents in Article 81 of the Highway Traffic Law No. 2918 adopted in 1983 have been re-evaluated in today's conditions. With the Circular No. 2007/27 of the Undersecretariat of Treasury, a method has been created that provides the parties with the right to agree in traffic accidents that result only in material damage. According to this method, as of April 1, 2008, on the condition of complying with the Traffic Law, the persons involved in the accident will be able to draw up the agreement report that will replace the "Traffic Accident Detection Report" by mutual agreement.

What is a "material damage traffic accident report"?

Only in cases of property damage traffic accidents, the parties involved in the accident will be able to fill in the material damage traffic accident detection report and apply to the insurance companies with this document, by agreeing among themselves, without the need for the traffic police to come.

In which cases it does not apply?

If one or more of the following situations are in question, it will not be possible to keep a material damage traffic accident report filled by the parties and therefore will not be accepted by Sompo Insurance. For this reason, in the cases listed below, the traffic police should be called and a record should be kept, as in the old practice. Apart from this, only in accidents with material damage, it is possible to prepare a report if the parties agree.

1. If he drives a motor vehicle without a driver's license or drives a motor vehicle with an insufficient driver's license,
2. If the driver is under age,
3. If the driver has alcohol use or suspected mental health
4. If one or more of the vehicles involved in the accident belong to public institutions,
5. If damage occurs to goods belonging to public institutions,
6. If only the belongings of third parties are damaged in a traffic accident,
7. If one or more of the vehicles involved in the accident do not have traffic insurance,
8. If the traffic accident resulted in death and/or injury.

Transactions to be made by Sompo Insurance regarding the report

1. The report, which is examined by the Tramer Unit, will be finalized within 3 days by determining the defect rates and agreed upon by the parties.
2. If the companies cannot agree on the defect rate, the defect rates will be decided within 3 days by the commission affiliated to the Insurance Information Center.
3. Defect rates will be determined as 0%, 50% or 100%, and intermediate values will not be used.
